What Your Umbrella Policy Won’t Cover — And Why It Matters
A commercial umbrella policy sits above your GL, commercial auto, and employers liability policies — extending your total liability protection beyond what any single policy can provide. For contractors facing large projects, high-value claims, and contract requirements, umbrella coverage is essential.
Professional Liability Exclusion
Commercial umbrella does not extend over professional liability. Errors in design, advice, or professional services are not umbrella-covered claims. You need adequate primary professional liability limits — umbrella provides no safety net above them.
Workers Compensation Exclusion
Umbrella does not replace workers compensation benefits. It may extend over employers liability (the third-party liability component of a WC policy), but the medical and indemnity benefits paid directly to injured workers are WC-only — umbrella doesn’t cover WC benefit obligations.
Pollution Exclusion
Most commercial umbrellas contain broad pollution exclusions. Contractors working with hazardous materials, asbestos, mold, or chemical applications need Contractors Pollution Liability (CPL) coverage — umbrella typically won’t help with pollution claims.
Intentional Acts Exclusion
Umbrella covers accidental, negligent liability — not intentional harm. If you or an employee intentionally injures someone or intentionally damages property, no liability policy (primary or umbrella) will cover it.
Aircraft and Watercraft Exclusions
Some umbrellas exclude aircraft and watercraft liability. Contractors using drones commercially or working on marine projects should verify their umbrella’s coverage for these exposures — and may need separate specialized liability coverage.
