State-by-State Threshold Overview
The majority of states require workers comp the moment you hire your first W-2 employee. This includes high-population states like California, New York, Florida, Texas (for those who elect coverage), Pennsylvania, and Illinois.
A smaller number of states have historically allowed thresholds — Alabama (5+), Arkansas (3+), and a few others. However, construction contractors in these states often still face a threshold of 1, because construction-specific statutes override the general employer threshold.
Part-time and seasonal employees generally count toward the threshold. If you hire a helper for three weeks in summer, they are an employee for workers comp purposes during those three weeks — even if you have no employees the rest of the year.
Construction-Specific Rules
Many states apply stricter workers comp rules to licensed contractors than to other employers. In Florida, virtually all construction contractors must carry coverage or hold an active state exemption — regardless of employee count. In California, any employer in construction must cover employees from day one.
State contractor licensing boards also frequently require proof of workers comp as a condition of license issuance or renewal — independent of the state employment mandate. Your license may require coverage even in a state where the employer law technically provides an exemption.
When in doubt, check both the state workers comp statute and the contractor licensing board requirements for your license type. They can be different.
