Mid-Term Cancellation of a Contractor GL Policy
Every contractor GL policy includes a cancellation provision that allows the insured to cancel at any time by providing written notice to the carrier. There is no waiting period, no statutory holdback, and no requirement that you have a reason. You simply send a signed cancellation request (a Lost Policy Release or a written letter) specifying the effective date of cancellation, and the policy ends on that date. What surprises most contractors is what happens next: the refund is calculated short-rate, not pro-rata. Short-rate cancellation means the carrier keeps a slightly larger share of the unearned premium as a penalty for cancelling early — typically about 10% of the unearned portion. On a $6,000 annual policy cancelled at the 6-month mark, pro-rata would refund $3,000; short-rate would refund roughly $2,700. The difference funds the carrier’s policy-issuance and underwriting cost.
There are two situations where pro-rata cancellation is allowed: (1) the policy is replaced by another policy with the same carrier (a re-write), or (2) you go out of business permanently. Some carriers also allow pro-rata if you sell the business or join an employer’s payroll. You must document these situations to qualify — a letter from the buyer of the business or a CPA-signed wind-down statement is typical.
After cancellation, the carrier will conduct a final premium audit based on your actual gross receipts (or payroll) for the months the policy was in force. If your revenue ran higher than what you estimated at inception, the audit will generate additional premium owed back to the carrier — which can wipe out or even exceed your refund. If your revenue ran lower, the audit will generate an additional credit. Always do a quick revenue check before cancelling so you are not surprised by an audit bill.
Finally, never let a GL policy lapse without binding a replacement first. Even a one-day gap can disqualify you from preferred carriers for years, expose you to uninsured claims, and put you in violation of every active GC contract and license you hold.
