Does commercial umbrella insurance cover workers compensation?
Workers compensation is a no-fault system — injured employees receive medical and indemnity benefits regardless of fault, and in exchange give up their right to sue. The WC policy pays these benefits directly. Umbrella doesn’t change this structure.
Employers liability is different — it covers claims by employees who can sue outside the WC system (dual employment, third-party actions, loss of consortium claims by a spouse). This component has limits ($100K–$500K typically), and umbrella extends over these limits.
Bottom line: if an employee is injured and files a WC claim, umbrella doesn’t help. If an injured employee sues you separately (in states or circumstances where that’s possible), employers liability covers the first layer and umbrella covers the excess.
