LLCs Can Hold Contractor Licenses in Most States
In most states, a contractor’s license can be issued to a business entity — including an LLC — rather than just to an individual. The license is then held at the company level, allowing any employee of the LLC to work under it.
The qualifying agent requirement: most states that allow entity-level licensing require a ‘qualifying agent’ — an individual who holds a personal contractor license and is associated with the LLC. The qualifying agent is personally responsible for the LLC’s licensed work. If the qualifying agent leaves the company, the LLC’s license may lapse until a new qualifying agent is designated.
Why license under an LLC: The LLC provides liability protection. If the business is sued, the LLC structure separates personal assets from business liabilities (insurance still handles claims — the LLC structure is an additional layer). It also allows the business to continue under the license even when individual employees change.
State variations: Florida allows contractor licenses to be held by qualifying businesses, with the individual qualifier being the link between the license and the entity. California issues the CSLB license to the business entity, with a qualifier who must hold a CSLB license. Most states follow a similar model.
